Triangle Lawn Games (TLG) – Terms and Conditions
Rain & Cancellation Policy
We appreciate your business and strive to be as flexible as possible in the event of weather-related changes or a change of plans. We offer a full refund for any reason up to 24 hours before your scheduled event start time. In case of rain or other weather conditions, we ask that you take care to keep our equipment dry. Customers will be held responsible for damage if the equipment becomes unusable due to exposure to the elements.
Equipment Rental Agreement
- Equipment
TLG agrees to lease equipment to the Customer as outlined in this rental agreement. - Lease Term
The lease term will begin on the dates selected by the Customer during checkout. - Lease Payment
The Customer agrees to pay the rental fee (“Rent”) for the equipment in advance of delivery.
- Full Payment, Damaged & Missing Equipment
The Customer must complete full payment to reserve the equipment before taking possession unless prior arrangements are made with TLG to pay by check. Full payment serves as security for the lease agreement and covers any potential damages caused by the Customer or their agents.
Damages include but are not limited to, paint scratches, dents, missing pieces, or any damage that affects the equipment’s functionality. Leaving equipment in the rain constitutes improper care and may result in additional charges for the repair or replacement of damaged or missing items.
TLG reserves the right to charge the Customer’s credit card on file for any damage or loss to the equipment.
- Late Charges
If the Customer returns the equipment more than one hour after the scheduled return time, they agree to pay a late fee equivalent to the full daily rental price. If the equipment is returned later than the scheduled return date, the Customer will be charged the daily rental rate for each day the equipment is overdue. - Return of Equipment
If the Customer fails to return the equipment on the agreed-upon return date, TLG reserves the right to take steps to recover the equipment. The Customer authorizes TLG and its agents to enter any premises owned or occupied by the Customer to repossess the equipment.
Liability & Indemnification
- Waiver of Liability
The Customer waives any rights to seek recovery from TLG for injuries sustained while using the equipment, including any injuries to individuals using the equipment under the Customer’s possession. TLG is not responsible for personal injury or property damage resulting from the use of the equipment. Additionally, TLG is not liable for any illness or COVID-19-related issues that may occur during an event. - Indemnification
The Customer agrees to indemnify and hold harmless TLG from any claims, losses, expenses, or fees (including attorney fees) resulting from the Customer’s or their agents’ use of the equipment, or any actions related to the rental agreement.
Miscellaneous Terms
- Assignment
The Customer may not assign this Agreement or sublease the equipment to any third party without prior written consent from TLG. The Customer must be present whenever third parties are using the equipment. - Entire Agreement & Modification
This document represents the entire agreement between the parties. No modifications or waivers of any terms shall be binding unless in writing and signed by both parties. - Severability
If any provision of this agreement is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect. If possible, any invalid provisions will be modified to make them enforceable. - Applicable Law & Venue
This agreement will be governed by the laws of the State of North Carolina. Any legal action arising from this agreement will be litigated exclusively in the state courts located in Wake County, North Carolina.
Delivery & Cancellation Policy
- Delivery & Pickup Responsibility
The Customer is responsible for being present at the delivery/pickup location at the agreed-upon time. TLG will wait for up to 15 minutes and will make multiple attempts to contact the primary point of contact. If no contact is made within this time frame, the reservation will be considered complete, and the TLG operator will leave the delivery site.
If the Customer and operator reconnect after the operator has left, the Customer will be charged an additional delivery fee for the extra trip to the location.
- Cancellation
Cancellations are allowed with a full refund up to 24 hours before the scheduled delivery or pickup time.
Online Privacy
By entering into this agreement, the Customer allows TLG to add them to our mailing list for future communications. Customers may opt out of these communications at any time.
By processing the order payment the Customer acknowledges and agrees to these terms and conditions, and affirms that they are familiar with the proper use of the equipment. The Customer agrees not to hold TLG responsible for any damage or personal injury as outlined above.
